Terms of Use
Article 1 - Definitions
In these terms and conditions, the following definitions apply:

Withdrawal period: The period within which the consumer can exercise their right of withdrawal;

Consumer: The natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;

Day: Calendar day;

Cancellation activities: A distance contract concerning a range of products and/or services, where the delivery and/or purchase obligation is spread over time;

Permanent data carrier: Any means that allows the consumer or entrepreneur to store information that is personally addressed to them in a manner that allows future inspection and reproduction of the stored information without alteration;

Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period;

Entrepreneur: The natural or legal person who offers products and/or services to consumers;

Distance contract: A contract that, until its conclusion, exclusively uses one or more remote communication technologies within a system organized by the entrepreneur for the remote sale of goods and/or services;

Remote communication technology: A means that can be used to conclude an agreement without the consumer and the entrepreneur being in the same room at the same time;

General terms and conditions: These general terms and conditions of the entrepreneur.
Article 2 - Identity of the Entrepreneur

Article 3 - Applicability
These general terms and conditions apply to all offers from the entrepreneur and to all distance contracts and orders concluded between the entrepreneur and the consumer. Before the conclusion of the distance contract, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, before the conclusion of the distance contract, it will be indicated that the general terms and conditions can be viewed at the entrepreneur’s business premises and will be sent free of charge to the consumer upon request.
If the distance contract is concluded electronically, the text of these general terms and conditions will be made available to the consumer in electronic form so that they can be easily stored on a durable medium. If this is not reasonably possible, the general terms and conditions will be consulted electronically before the conclusion of the distance contract and will be sent to the consumer either free of charge or by other means.
If specific product or service conditions apply in addition to these general terms and conditions, paragraphs 2 and 3 apply accordingly, and in the event of conflicting general terms and conditions, the consumer may always rely on the most favorable version.
If one or more provisions of these general terms and conditions are wholly or partially invalid or are annulled at any time, the contract and these general terms and conditions will remain in full force, and the provision in question will be replaced by a provision that approximates the initial intent as closely as possible.
Situations not covered by these Terms and Conditions must be assessed "in the spirit" of these Terms and Conditions. Any ambiguity regarding the interpretation or content of one or more provisions of our General Terms and Conditions will be interpreted "in the spirit" of these General Terms and Conditions.
Article 4 - The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer. The offer is open. The entrepreneur has the right to modify and adjust the offer. The offer contains a complete and precise description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to properly evaluate the offer. If the entrepreneur uses images, they accurately reflect the product, products, and/or services offered. Obvious errors or mistakes in the offer do not bind the entrepreneur.
All images, specifications, and data in the offer are indicative and cannot lead to any compensation or contract termination. Product images are a faithful representation of the offered products. The company cannot guarantee that the displayed colors exactly match the actual colors of the products.
Each offer contains information allowing the consumer to see what rights and obligations are associated with accepting the offer. These include:

The price excluding customs clearance and import sales tax. These additional costs are the responsibility and risk of the customer. The postal and/or courier service applies special rules for postal and courier services for importation. This rule applies when goods are imported into the EU destination country;

Any shipping costs;

The manner in which the contract was concluded and the necessary actions for this;

Whether the right of withdrawal applies or not;

The type of payment, delivery, and execution of the contract;

The deadline for accepting the offer or the period within which the entrepreneur guarantees the price;

The amount of the long-distance communication tariff if the costs of using long-distance communication technology are calculated on a basis other than the regular basic rate of the communication medium used;

Whether the contract is archived after its conclusion and, if so, how the consumer can access it;

The way the consumer can verify and, if necessary, correct the information they provided before concluding the contract;

Any language other than Dutch in which the contract may be concluded;

The codes of conduct to which the professional is subject and how the consumer can consult these codes electronically;

The minimum duration of the distance contract in the case of a long-term transaction.
Article 5 - The Contract
According to paragraph 4, the contract is formed when the consumer accepts the offer and meets the specified conditions. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the electronic acceptance of the offer. As long as the entrepreneur has not confirmed receipt of this acceptance, the consumer can terminate the contract.
If the contract is concluded electronically, the entrepreneur must take appropriate technical and organizational measures to protect the electronic transmission of data and ensure a secure web environment. If the consumer can pay electronically, the entrepreneur takes appropriate security measures.
The entrepreneur may, within legal limits, inquire about the consumer’s ability to fulfill payment obligations, as well as all facts and factors relevant to responsibly concluding the distance contract. If, based on this investigation, the entrepreneur has valid reasons not to conclude the contract, they are entitled to refuse an order or request or to attach special conditions to its execution.
The entrepreneur provides the consumer with the following information in writing or in a way that the consumer can store on a durable medium:

The address of the entrepreneur’s establishment where the consumer can submit complaints;

The conditions and manner in which the consumer can exercise their right of withdrawal, or a clear statement on the exclusion of the right of withdrawal;

Information on existing guarantees and after-sales services;
-
The conditions for contract termination if the contract lasts more than a year or is indefinite.
